DEPARTMENTOFTHENAVY OFFICEOFTHESECRETARY WASHINGTON,D.C.20350-1000 SECNAVINST4200.34 ASN(RD the Military Departments,including the Coast Guard when operating as a Service in the Navy; the Chairman, Joint Chiefs of Staff and the Joint Staff; the Combatant Commands; the Inspector General of the Departmentof Defense(IG, DoD); and the Defense Agencies(hereafter referred to collectivelyas “DoD Components”) . c.DEFINITIONS Terms used in this Instruction are defined in enclosure2. Enclosure(1) D. of EQLu2x It is DoD policy that: 1.The DoD Componentsshall rely on the most effective mix the Total Force, cost and other factors considered,including Active,Reserve,civilian, host-nation,and contract resources necessaryto fulfill assigned peacetimeand wartime missions. 2.Contractorsprovidingservices designatedas essential by a DoD Componentare expectedto use all means at their disposal to continue to providesuch services, in accordance with the terms and conditionsof the contract during periodsof crisis, until appropriatelyreleased or evacuated by militaryauthority. 3.DoD Componentsworking with contractors performing essentialservices shall develop and implement plans and procedureswhich are intended to providereasonableassurance of the continuationof essentialservices during crisis situations using contractoremployees or other resources as necessary. 4.For situations where the cognizant DoD Component Commander has a reasonable doubt about the continuationof essentialservices during crisis situations by the incumbent contractor,the Commandershall prepare a contingency plan for obtaining the essentialservice from alternate sources(military, DoD civilian, host-nation,other contractor(s) . E.RESPONSIBILITIES 1.The AssistantSecretarv of Defense(Force Manaementand Personnel)(ASD(FM&P) shall periodicallymonitorimplementation of this Instruction. 2.The Heads of DoD Componentsshall: a.Ensure that the policy and proceduresin this Instruction are implemented by relevant subordinate organizations . b.Ensure that all contractorservices are reviewed annually, to include new and existing contracts, to determine which services will be essential during crisis situations. c.Conduct an annual assessment of the unanticipated and/or prematureloss of essential contractorservices on the effectivenessof support to mobilizingand deployedforces. Include the results of these assessmentsinto relevant portions 2 kW6, 90 3020037 of the affectedcontingencyand/or operations plans,consistent with JCS planningguidance. d.Provideassistance to FMS customersin prioritizing security assistancerequirements,planningfor the retentionof essentialcontractorpersonnelin a crisis, andrecommending required actionsrelative to continuationor terminationof security assistanceprograms. e.Advisethe ASD(FM&P)of any significant problemsin implementingthis Instruction. 3.The Chairman,Joint Chiefs of Staff(CJCS) shall: a.Establish proceduresfor the preparationand review of contingencyplans by the CombatantCommanderswhich conform to policy guidancefrom the Presidentand the Secretary of Defense. Planning guidanceshall include the review and assessmentof alternativesto continue contractorservices identifiedas critical to the”executionof the plan. b.Reviewfor adequacy and feasibility,operations and/or contingencyplans developed by the CombatantCommandersas part of the establisheddeliberate planning processof the Joint Strategic PlanningSystem. c.Monitor the executionof contingencyplansfollowing activation by the applicable trigger mechanism(identified in paragraph5. of enclosure2). F.PROCEDURES The following essentialservices planning proceduresapply to DoD Componentactivitiesusing contractorservices in peacetime: 1.Identify services designatedas mission essentialin the contractstatement of work(SOW). 2.Maintain,in a current status, the followinginformation: a.The generic descriptionof the essentialcontractor service. b.The name, address, and telephone numberof the contractor performingthe essentialservice. c.The name, address, and telephonenumber of the in-countrycontact for the DoD activity using the essential service, if overseas. 3 . d.The number of contractoremployeesand equivalent man-yearsrequired to perform the essentialservice. e.The number of dependentsof designated-essential contractoremployeesto be included in noncombatantevacuation planning,if overseas. 3.Issue Geneva Conventionidentity cards in accordancewith DoD Instruction1000.1(reference(c), to essentialcontractor personneloverseas. 4.For situationswhere a reasonableassuranceof continuationof essentialservices by a contractorcannot be attained, the cognizant DoD Component ActivityCommandershall do one of the following: a.Obtain military,DoD civilian,or host-nation personnelto perform the services concernedand, in consultation with appropriatelegal and contractingpersonnel?determinethe propercourse of actions to transitionfrom contractorprovided services. b.Preparea contingencyplan for obtaining the essential ser
